Terms & Conditions
Welcome to Drive Me Home by nightfall (“Drive Me Home”, “Nightfall”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our mobile applications, websites, and related services that arrange a certified sober rider to drive your vehicle to your destination.
By creating an account, requesting a ride, accepting a dispatch as a driver, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are & what the Service is
Drive Me Home is a technology platform that connects customers who need a safe ride home in their own car with independently contracted sober drivers (“Drivers” or “Riders”). We are not a traditional taxi or fleet operator: the vehicle remains yours, and the Driver operates it on your behalf for the duration of the trip.
- We currently focus on Colombo and surrounding areas in Sri Lanka, expanding over time.
- Availability depends on Driver supply, time of night, weather, and operational capacity.
- App store listings, marketing pages, and in-app copy are part of how we describe the Service but these Terms control if there is a conflict.
2. Accounts & eligibility
To use the Service you must:
- Be at least 18 years old and legally able to enter a binding contract under Sri Lankan law;
- Provide accurate mobile number and profile details, and keep them up to date;
- For customers: have lawful authority to allow a Driver to operate the vehicle you nominate;
- For Drivers: hold a valid Sri Lankan driving licence, meet our onboarding and background requirements, and remain sober while on duty.
You are responsible for activity under your account. Do not share OTP codes or session tokens. We may suspend or terminate accounts that appear compromised, abusive, or fraudulent.
3. Booking a trip
When you request a trip you confirm that:
- Pickup and drop-off details are correct;
- The vehicle is roadworthy, insured as required by law, and you are authorised to have it driven;
- You (and any passengers) will follow reasonable safety instructions from the Driver;
- You will not ask the Driver to break traffic laws, transport illegal goods, or drive while you interfere with vehicle controls.
Estimated fare, distance, and arrival times are estimates only. Final charges follow our published pricing rules (base fee, time-related fees, and distance-based charges) shown in the app at request time.
4. Payments, authorisation & cancellations
Card payments are processed by our payment partner (currently Stripe). For most trips we pre-authorise (hold) your card before the request is published to Drivers. The hold is captured when a Driver accepts your trip. If no Driver accepts and you cancel, or the request expires under our rules, the hold is released according to your bank’s timelines.
- Cash collection is not offered unless we expressly re-enable it in the app.
- Failed authorisation means the trip will not be published.
- Chargebacks filed in bad faith, repeated no-shows, or abuse of refunds may lead to account restriction.
- Promotional credits, if any, are applied under the rules shown with each offer and have no cash value.
5. Drivers (platform riders)
Drivers are independent contractors, not employees of Nightfall, unless a separate written agreement says otherwise. Drivers must remain sober, drive safely, treat customers and property with care, and only accept trips they can complete. Nightfall may deactivate Drivers who fail safety, conduct, or documentation standards.
6. Safety, alcohol & your responsibilities
The Service exists so people who have been drinking — or who simply prefer not to drive — can get home in their own car. You remain responsible for your passengers, valuables left in the vehicle, and any damage you cause. Report accidents, injuries, or unsafe behaviour to emergency services first (119 / 118 as applicable in Sri Lanka), then to Nightfall support.
- Do not leave minors unattended with a Driver unless permitted by law and agreed in advance through support.
- Weapons, open containers that create a hazard, or violent behaviour are grounds for immediate trip cancellation.
- Seat belts must be used. Nightfall may cancel trips that become unsafe.
7. Insurance & liability
Vehicle insurance obligations remain with the vehicle owner/customer as required by Sri Lankan law. Nightfall provides a technology marketplace and related support; to the fullest extent permitted by law we are not liable for indirect, incidental, or consequential losses (including lost profits, data, or goodwill) arising from trips, Driver acts, network outages, or third-party payment processors.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence where such exclusion is prohibited).
8. Acceptable use
You agree not to:
- Scrape, reverse engineer, or disrupt the apps, APIs, or payment flows;
- Create fake accounts, manipulate GPS, or game dispatch;
- Harass, threaten, or discriminate against Drivers, customers, or staff;
- Use the Service for unlawful purposes.
9. Intellectual property
Nightfall, Drive Me Home, logos, app design, and software are owned by us or our licensors. You receive a limited, non-exclusive, revocable licence to use the apps for personal or authorised commercial use as a Driver.
10. Privacy
How we collect and use personal data is described in our Privacy Policy. By using the Service you acknowledge that processing.
11. Changes & termination
We may update these Terms from time to time. Material changes will be posted on this page and/or notified in-app. Continued use after the effective date means you accept the updated Terms. You may stop using the Service at any time. We may suspend or end access where reasonably necessary for safety, fraud, legal, or operational reasons.
12. Governing law
These Terms are governed by the laws of Sri Lanka. Courts in Colombo shall have non-exclusive jurisdiction, without prejudice to any mandatory consumer protections that apply to you.
